What Is the Statute of Limitations in California For Wrongful Death?
In California, the statute of limitations for filing a wrongful death lawsuit is two years from the date of the person’s death. This time limit is set by the California Code of Civil Procedure. Only certain family members, such as spouses, domestic partners, children, or parents, are typically eligible to file a claim.
Missing this deadline can prevent the claim from moving forward, so it’s important for eligible survivors to act promptly if they plan to pursue legal action.
